These Terms & Conditions apply to the use of www.mxnwines.co.uk and to all purchases made through our website.

By using our website or placing an order, you agree to these Terms & Conditions.

Please read them carefully before placing an order.

In these Terms & Conditions, “we”, “us” and “our” refer to MXN Wines Ltd. “You” and “your” refer to the customer using our website or placing an order.


2. Age restriction

We sell alcoholic products. You must be 18 years old or over to place an order on our website.

By placing an order, you confirm that:

  • you are at least 18 years old;
  • the person receiving the delivery is at least 18 years old;
  • the alcohol is being purchased for lawful personal or business use.

We reserve the right to cancel any order if we believe the order has been placed by or for a person under the age of 18.

Alcohol must not be sold to anyone under 18 in the UK, and Scottish guidance recognises age verification policies such as Challenge 25 as an important way to reduce underage alcohol sales.


3. Age verification and delivery ID checks

Our couriers may ask for valid photographic ID at the point of delivery.

We or our delivery partners may operate a Challenge 25 policy. This means that if the recipient appears under 25, they may be asked to provide proof that they are 18 or over.

Accepted ID may include:

  • passport;
  • UK or EU photocard driving licence;
  • PASS-accredited proof-of-age card;
  • other valid photographic ID accepted by the courier.

If valid ID is not provided, delivery may be refused and the order may be returned to us.

Where delivery fails due to failed age verification, refusal of delivery, or no eligible adult being available to accept the order, we may deduct delivery, return, courier and reasonable handling costs from any refund.


4. Use of our website

You agree to use our website only for lawful purposes.

You must not:

  • use our website in a way that breaches any law or regulation;
  • attempt to interfere with the security or operation of the website;
  • submit false, misleading or fraudulent information;
  • use our website to purchase alcohol for anyone under 18;
  • copy or misuse our website content, branding, photographs or product descriptions without permission.

We reserve the right to restrict or block access to our website if we believe it is being misused.


5. Product information

We aim to ensure that all product descriptions, prices, images, vintages, tasting notes and availability information on our website are accurate.

However, wine is a natural product and may vary slightly between vintages, batches and bottles.

Product images are for illustration only. Packaging, labels, bottle shape, capsule colour, vintage or presentation may vary from the images shown.

We reserve the right to correct any errors, inaccuracies or omissions at any time.


6. Prices

All prices are shown in pounds sterling (£).

Prices include VAT where applicable, unless stated otherwise.

Delivery charges are not included in the product price unless clearly stated. Delivery costs will be shown at checkout before you place your order.

We reserve the right to change prices at any time. Price changes will not affect orders that have already been accepted by us.


7. Orders and contract formation

When you place an order on our website, you are making an offer to buy the products in your basket.

After placing an order, you may receive an order confirmation email. This confirms that we have received your order, but it does not necessarily mean that your order has been accepted.

A contract between you and MXN Wines Ltd is formed when we dispatch your order or confirm that your order has been accepted.

We reserve the right to refuse or cancel an order for any reason, including where:

  • the product is unavailable;
  • payment has not been authorised;
  • the delivery address is incomplete or incorrect;
  • age verification checks are not passed;
  • we suspect fraud or misuse;
  • there has been a pricing or product description error;
  • delivery to your address is not available;
  • fulfilling the order may breach alcohol licensing rules or other legal requirements.

If we cancel an order after payment has been taken, we will refund the amount paid, unless we are entitled to make deductions under these Terms & Conditions or our policies.


8. Payment

Payment must be made in full at the time of placing your order.

We accept the payment methods shown at checkout.

You confirm that the payment method used belongs to you or that you have permission to use it.

Orders will not be dispatched until payment has been received and authorised.


9. Stock availability

All products are subject to availability.

If a product becomes unavailable after you place your order, we may offer you:

  • a replacement product;
  • a delayed dispatch;
  • a partial refund;
  • a full refund.

We will contact you where necessary before making any substitution.


10. Delivery

Delivery is governed by our Shipping Policy, which forms part of these Terms & Conditions.

You must provide accurate and complete delivery information at checkout.

You are responsible for ensuring that someone aged 18 or over is available to accept the delivery.

Delivery times are estimates only and are not guaranteed unless we specifically agree otherwise in writing.

Unless a different delivery period is agreed, UK consumer rules generally require goods bought online to be delivered within 30 days.

We are not responsible for delays caused by:

  • courier disruption;
  • weather;
  • strikes;
  • public holidays;
  • incorrect or incomplete delivery details;
  • failed age verification;
  • customer absence;
  • events outside our reasonable control.

11. Failed delivery

If delivery fails because:

  • no one is available to receive the parcel;
  • no person aged 18 or over is available;
  • valid ID is not provided;
  • the recipient refuses delivery;
  • the address is incorrect or incomplete;
  • the courier cannot access the property;
  • the parcel is not collected from a depot or collection point;

the parcel may be returned to us.

In these circumstances, we may deduct from any refund:

  • the original delivery cost;
  • the return delivery cost;
  • courier fees;
  • reasonable handling or restocking costs;
  • the cost of any goods that are damaged, spoiled, broken or no longer resaleable.

If you ask us to resend the order, you may need to pay a new delivery charge.


12. Safe place and third-party delivery instructions

Alcohol orders should not be left unattended.

If you instruct the courier to leave your parcel in a safe place, with a neighbour, concierge, reception, workplace, collection point or other third party, responsibility may pass to you once the courier follows those instructions.

We are not responsible for loss, theft, damage or failed age verification issues caused by customer delivery instructions.


13. Cancellations, returns and refunds

Your cancellation, return and refund rights are governed by our Returns & Refund Policy, which forms part of these Terms & Conditions.

For most online purchases, consumers have the right to cancel an order within 14 days of receiving the goods, without giving a reason. After notifying the seller, the customer usually has a further 14 days to return the goods.

Returned goods must be:

  • unopened;
  • sealed;
  • unused;
  • in their original packaging;
  • in a resaleable condition;
  • safely packaged for return.

We may reduce your refund if the goods have been handled beyond what is necessary to check their nature, characteristics and condition.

Opened bottles, broken seals, partially consumed products or products damaged after delivery cannot be returned for change-of-mind reasons.

This does not affect your statutory rights if goods are faulty, damaged on arrival or not as described.


14. Damaged, faulty or incorrect goods

Please inspect your order as soon as it arrives.

If your order is damaged, faulty, leaking, corked, incorrect or not as described, please contact us as soon as possible at:

  • your order number;
  • photographs of the product;
  • photographs of the outer packaging;
  • photographs of the courier label;
  • a short description of the issue.

Where the issue is confirmed, we will offer an appropriate remedy, which may include a replacement, refund or partial refund.

Please do not dispose of the product or packaging until we have reviewed the issue, as evidence may be required for courier claims.


15. Wine quality and storage

Wine should be stored responsibly after delivery.

You should store wine:

  • away from direct sunlight;
  • away from excessive heat;
  • away from freezing temperatures;
  • in suitable conditions for wine storage.

We are not responsible for deterioration, leakage, cork movement, flavour changes or damage caused by incorrect storage, mishandling or negligence after delivery.


16. Promotions, discount codes and gift cards

Promotions, discount codes and gift cards are subject to availability and any specific terms stated at the time of issue.

We reserve the right to withdraw, amend or refuse a promotion or discount code where:

  • it has expired;
  • it has been used incorrectly;
  • it is being abused;
  • it was issued in error;
  • the order does not meet the promotion requirements.

Discount codes cannot usually be exchanged for cash.

If a refund is issued for an order paid partly or fully with a discount, voucher or promotion, the refund will reflect the amount actually paid.


17. Trade and business customers

These Terms & Conditions apply primarily to consumer purchases made through our website.

Trade, wholesale, restaurant, wine bar, hospitality or business-to-business orders may be subject to separate trade terms agreed in writing.

Business customers should inspect goods immediately upon delivery and notify us promptly of any damage, shortage or incorrect items.

We reserve the right to refuse trade pricing, credit terms or wholesale supply at our discretion.

All content on our website, including text, images, logos, graphics, product descriptions, branding and layout, belongs to MXN Wines Ltd or our licensors unless stated otherwise.

  • loss of business;
  • loss of opportunity;
  • loss caused by courier delays outside our control;
  • loss caused by incorrect delivery information supplied by you;
  • damage caused by incorrect storage or handling after delivery.

For consumer orders, our total liability will not exceed the price paid for the products and delivery charges relating to the order in question, except where the law provides otherwise.


22. Events outside our control

We are not responsible for failure or delay in performing our obligations where this is caused by events outside our reasonable control.

This may include:

  • courier disruption;
  • strikes;
  • severe weather;
  • fire, flood or natural disaster;
  • government restrictions;
  • licensing or regulatory changes;
  • supplier delays;
  • import or customs disruption;
  • technical failures;
  • cyber incidents;
  • pandemics or public health emergencies.

If such an event affects your order, we will contact you where reasonably possible.
